PA-ACP has been lobbying for this immunity, knowing that all of its members had been forced to change operations, forestall needed tests and procedures, and that patients were staying home, putting off necessary care. Trial lawyers are already active filing suits over actions taken during the state’s emergency orders.

Legislation has been introduced to give physicians limited protection for actions taken that may have been affected by the pandemic or state guidance.  But time is short to move this before the legislative session ends.

SB 1239, introduced by Sen. Lisa Baker, would give internists and others challenged by dealing with the COVID-19 pandemic and state required responses with targeted, temporary protection from opportunistic lawsuits.  We need to demonstrate to the other members of the State Senate that there is support for this legislation - and a real need for physicians to have that protection.
